Yes – there is still hope for illegal immigrants, and we are saying that on two basis. The first piece of good news recently happened with already forgotten and doomed failed President Obama’s Immigration Reform – his Executive Order #2 on Immigration Action (immigration reform) which was supposed to cover and legalize approximately half of illegal immigrant population in the United States – about 4-5 million. After his Executive Order failed and was stalled by first Federal District Court and then Federal Appeals court (called Federal Circuit Court), recently Supreme Court of the United States agreed to review it, giving it at least some chance of success, as if successful it would at provide at least a temporary reprieve from deportation and will provide work authorizations to millions of illegal immigrants. The second point always existed but was rarely used. Many immigrants who fell out of status believe that once illegal they have to stay in the shadows and continue being illegal, which given the increased enforcement activities is the worst option of all. However, many including those who entered the country illegally still have other options of legalization on an individual ground – such as filing political asylum application and work permit on that basis, cancellation of removal and green card by the immigration court on many other basis that for most individual cases there is and have never been a reason to wait for the success (or failure) of President Obama’s Executive Action on Immigration. Therefore, regardless of the action the Supreme Court may take some time in June of this year regarding President Obama’s actions, we strongly advise those who are out of status to take the action and not wait for the outcome of that court case.
